General terms of use and sale

Article 1 — Purpose
These general terms (the "Terms") govern access to the BriefBench service, its use and the sale of its subscriptions.
BriefBench is an online service. It helps professionals find and analyse content creators on Instagram, TikTok and YouTube, based on their public profiles.
BriefBench is published by Bahri Labs, an SAS with a share capital of €100, RCS Paris 109 283 416, whose registered office is at 47 rue Vivienne, 75002 Paris ("we").
The Terms apply to anyone who creates an account ("you" or the "Customer"). Specific terms may be agreed in writing, in particular for the Enterprise offer. In case of conflict, they prevail over the Terms.
Article 2 — Service reserved for professionals
BriefBench is reserved for professionals.
By creating an account or subscribing, you declare that you act for purposes within your commercial, industrial, craft, liberal or agricultural activity, for yourself or on behalf of another professional.
You declare this by ticking the box provided at sign-up, before payment or on the screen where the Terms are accepted; we may ask you for your company name and your SIREN or VAT number.
If an account was opened for non-professional purposes, we may close it; the amounts paid for the current period are then refunded.
Article 3 — Acceptance of the Terms
You accept the Terms:
1. at sign-up, by ticking the checkbox provided; 2. if your account existed before the Terms were published, or when a new version is published, on the screen shown before you continue; 3. at payment, by ticking the checkbox on the payment page.
We keep the accepted version and the date of acceptance.

Article 4 — Account
To use BriefBench, you create an account with an e-mail address and a password, or with the third-party sign-in button offered on the sign-up page.
You provide accurate information and keep it up to date. You keep your login details confidential. You tell us without delay about any unauthorised use of your account.
One account is for one user. There are no additional seats. Your login details are personal: an account is not shared between several people.
You can delete your account yourself, from your settings, after confirming your identity by signing in again and typing the account's e-mail address. You can also ask for it by writing to privacy@briefbench.app.
Deletion is immediate and permanent: any current subscription is cancelled at once, without waiting for the end of the period; your sign-in identity is deleted and you are signed out of all your devices; your data — searches, watches, folders, assistant conversations, notifications, settings — is erased from our database. If the subscription cancellation fails, nothing is deleted and you can try again. If a later step fails, the account is already closed, and the erasure is retried every night by an automated task until it succeeds.
We then keep an anonymous record of the deletion — its date, whether it came from you or from our team, and whether a paid subscription was cancelled — and internal entries that no longer identify you. What happens to a period already paid for is covered in Article 13. We keep invoices and billing data for ten years, as long as our accounting obligations require.
In the event of a serious breach of the Terms, we may suspend and then close your account, after notifying you by e-mail and giving you fifteen days to remedy it, except in an emergency (fraud, threat to security).
Article 5 — The service
Depending on your plan, BriefBench lets you in particular:
- search for content creators on Instagram, TikTok and YouTube from a brief;
- chat with an assistant based on artificial intelligence;
- view, for each creator, public statistics and analyses;
- sort creators into folders and share a folder with a link;
- save watches, up to 20 per account;
- see creators' contact details and export lists in CSV format (paid plans).
Creator data comes from public profiles, obtained through collection providers. It is analysed automatically, in particular by artificial intelligence.
Information about creators comes from their public profiles and from our estimates; it is provided for guidance only, as of the date it was collected, and we do not guarantee that it is accurate, up to date or complete.
The service changes over time. We may add, change or remove features. The removal of a feature included in your paid plan is announced by e-mail at least thirty days in advance.
Article 6 — Retention of assistant conversations
A conversation with the assistant is deleted after 90 days without a new message. A banner in the conversation warns you 7 days before. Each new message restarts the period.
Article 7 — Plans and credits
Four plans are offered. Their details are in Annex A.

Each paid action uses credits. The cost of each action is in Annex B.
Your credits are renewed on the 1st of each month, at 0:00 (UTC), at the level of your plan. Unused credits do not carry over. They have no monetary value and are not refundable. Credits cannot be topped up.
If your credits run out, paid actions are refused until the next renewal or until a plan change. Actions costing 0 credits remain available.
If you move to a higher plan during the month, your credit ceiling is raised at once. If you move to a lower plan, the higher ceiling is kept until the end of the month.
We may change the credit cost of an action; the new table is announced by e-mail and in the product at least thirty days before it applies.
Article 8 — Prices, VAT and invoices
Prices are shown in euros, excluding tax, per month. VAT is added at payment, according to the country of your billing address.
If you are established in another Member State of the European Union and provide a valid intra-EU VAT number at payment, the invoice is issued without French VAT, which you account for under the reverse-charge mechanism; otherwise, the applicable VAT is added to the price.
An invoice is issued for each payment. You can find it in your settings, under "Payment method & invoices".
The Enterprise offer starts at €490 excluding tax per month. It is quoted on request: write to hello@briefbench.app.
We may change our prices. A new price applies from the next period, after thirty days' notice by e-mail.
Article 9 — Payment and renewal
Payment is made by bank card, through our payment provider. The first month is paid at subscription.
The subscription then renews every month, on the anniversary date, and is paid on that date, until it is cancelled. The next renewal date is shown in your settings.
In case of late payment, the following are due automatically:
- late-payment penalties, payable without reminder from the day after the payment date shown on the invoice, at the rate of the European Central Bank's refinancing rate plus ten points;
- a flat-rate fee of €40 for recovery costs.
Article 10 — Plan changes
You can move to a higher plan at any time, from your settings. The change is immediate. The price difference for the current period is prorated and invoiced at once.
You can move to a lower plan from your settings. The change takes effect at the end of the current period.
No plan change is possible while a payment is overdue.
Article 11 — Cancellation
You can cancel your subscription at any time, from your settings ("Cancel" button). Cancellation takes effect at the end of the current monthly period. You keep your plan until that date, then your account moves to the Free plan. Until that date, you can undo the cancellation.
The current period remains due; cancellation does not give rise to any refund.
In the event of a serious breach — use contrary to Article 15, fraud, a threat to the security of the service, an unpaid amount not settled —, we may cancel your subscription and close your account after a formal notice by e-mail has remained without effect for fifteen days; in an emergency, closure is immediate.
If we discontinue BriefBench, we inform you by e-mail at least thirty days in advance; paid periods not yet used are refunded, and the export features remain available until the service stops.
Article 12 — Failed payment and grace period
If a payment fails, we tell you by e-mail. Your plan stays active during a 7-day grace period. We send you a reminder less than 48 hours before the end of that period.
During the grace period, you can update your payment method from your settings. You cannot change plans.
If the payment is not settled by the end of the grace period, your account returns to the Free plan. We tell you by e-mail.
We do not pursue recovery of the unpaid period; the penalties of Article 9 apply only to invoices issued on a quote.
Article 13 — Refunds
No period that has begun is refunded, except in the event of a billing error on our part or the discontinuation of the service (Article 11).
Deleting your account ends your subscription immediately; the current period is not refunded.
Article 14 — Availability
We do our best to keep BriefBench available. The service may be interrupted for maintenance, for an update or for an external cause, such as a provider outage.
Part of the data depends on third-party platforms (Instagram, TikTok, YouTube) and on collection providers. If their access changes, some features may be limited.
We do not guarantee an availability rate. When scheduled maintenance interrupts the service, we announce it in advance in the product or by e-mail; urgent work may take place without notice.
Article 15 — Acceptable use
You use BriefBench for your professional activity, fairly and lawfully. In particular, you may not:
- resell, rent or transfer to a third party access to the service or the data it provides — except for the needs of a campaign you run for your own client, without giving them access to the service or passing on the raw data;
- extract data from the service with a robot or any other automated means;
- get around your plan's limits or the security measures;
- use the service to harass, discriminate against or harm anyone.
Creator data. The creators shown in BriefBench are natural persons. When you use their data, in particular their contact details, to contact them, you do so under your own responsibility, each of us being a data controller for its own processing: we for collecting the data and making it available, you for the use you make of it. In particular, you undertake to:
- contact a creator only with a proposal related to their work as a creator;
- tell them, at the latest at first contact, who you are, where their data comes from and that they have the right to object;
- respect their objection at once and stop contacting them;
- follow the rules on electronic direct marketing;
- keep their data no longer than your project needs;
- not process sensitive data about them.
An account that does not comply with this article is suspended and then closed under the conditions of Article 11.
Article 16 — Personal data
We process our users' personal data as explained in our privacy policy: https://briefbench.app/en/privacy.
Creators whose public profile appears in BriefBench are informed through a dedicated page: https://briefbench.app/en/privacy/creators.
Each of us is a data controller for its own processing (Article 15); no data processing agreement is entered into between us.
Article 17 — Intellectual property
The BriefBench software, website, texts, trademarks and databases belong to Bahri Labs.
We grant you a personal, non-exclusive and non-transferable right to use the service for your professional activity, for as long as your account exists.
You keep ownership of the content you enter (briefs, notes, folders). You allow us to process it to provide the service.
You may use your exports for your internal needs and your campaigns, including those you run for your own clients, in compliance with Article 15.
Creators' names, photos and content remain the property of their authors; the service lets you view them, it does not transfer any rights in them to you.
Article 18 — Liability
We provide the service with care, as a best-efforts obligation. We guarantee neither the success of your campaigns nor a creator's reply.
Statistics and analyses are built from public data and automated processing, and provided for guidance only, under the conditions of Article 5.
We are not liable for indirect damage, such as loss of revenue, customers or data, loss of profit or damage to reputation.
Our total liability, for all causes combined, is limited to the amounts you paid us in the twelve months preceding the event giving rise to the claim. This limit does not apply in case of gross negligence or wilful misconduct, personal injury, and wherever the law prohibits it.
You are responsible for how you use the data obtained through BriefBench, in particular for your contacts with creators (Article 15).
We are not liable for a failure caused by an event of force majeure within the meaning of Article 1218 of the French Civil Code.
Article 19 — Changes to the Terms
We may change the Terms. We inform you of any new version by e-mail and in the product, thirty days before it takes effect.
The new version applies once accepted, on the screen described in Article 3. If you refuse it, you can cancel your subscription free of charge, with effect at the end of the current period, which remains due, or delete your account.
Each version is dated. Previous versions are kept and provided to you on request at legal@briefbench.app.
Article 20 — Governing law and disputes
The Terms are governed by French law.
In case of dispute, please first write to legal@briefbench.app to seek an amicable solution for thirty days.
Failing agreement, the Paris economic activities court (tribunal des activités économiques de Paris) has sole jurisdiction, including in the event of multiple defendants or third-party proceedings.
Article 21 — Language
The Terms are offered in French and in English. In the event of a discrepancy, the French version prevails.
